1. Agreement to Terms

By accessing or using the services provided by Rain ("we," "us," or "our") at https://heyrain.xyz, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Description of Service

Rain is an AI-powered Shopify theme editor. You describe the changes you want to make to your Shopify store's theme in plain language, and our AI edits your theme files — Liquid templates, CSS, sections, snippets, and configuration — directly. Changes are applied as an unpublished draft theme that you can preview before publishing.

Our services include:

  • AI-powered theme editing via a chat interface
  • Shopify store connection via OAuth
  • Theme file download, editing, and push-back
  • Draft theme preview before publishing
  • ZIP download of edited theme files

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 16 years old to use our services.
  • One person or entity may not maintain more than one account.
  • You are responsible for all activity that occurs under your account.

4. Shopify Store Connection

  • By connecting your Shopify store, you authorize Rain to access and modify your store's theme files.
  • Rain accesses theme files only — we do not access your customer data, orders, or financial information.
  • You can disconnect your store at any time from your account settings.
  • You are responsible for reviewing and publishing any theme changes Rain makes.

5. Credits and Payments

Credits

  • Theme editing requests consume credits from your account balance.
  • Credit usage varies by plan. Free accounts receive a one-time allocation of credits.
  • Unused credits do not roll over between billing periods (for paid plans).

Billing

  • Paid plans are billed in advance on a monthly or annual basis through Stripe.
  • All fees are exclusive of taxes unless stated otherwise.
  • You authorize us to charge your payment method for recurring subscription fees.

Price Changes

  • We may change our prices with 30 days' advance notice.
  • Price changes take effect at the start of your next billing period.

6. Cancellation and Refunds

  • You may cancel your subscription at any time from your account settings.
  • Cancellation takes effect at the end of your current billing period.

7. Acceptable Use

You agree not to use our services to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Attempt to gain unauthorized access to our systems or other users' stores
  • Use our service to inject malicious code into Shopify themes
  • Reverse engineer, decompile, or disassemble our software
  • Resell or redistribute our services without authorization
  • Exceed your plan's credit allocation through automated or bulk requests

8. Intellectual Property

Our Content

All content, features, and functionality of our services (including but not limited to text, graphics, logos, and software) are owned by Rain and protected by intellectual property laws.

Your Content

  • You retain full ownership of your Shopify theme and any modifications Rain makes to it.
  • You grant us a limited license to access, process, and modify your theme files as necessary to provide our editing service.
  • We do not claim ownership of your theme files or the changes we generate.

9. AI-Generated Code

  • Rain uses AI to generate code changes for your Shopify theme.
  • AI-generated code is provided "as is." While we strive for accuracy, you are responsible for reviewing all changes before publishing them to your live store.
  • We recommend previewing all theme changes using Shopify's draft theme preview before making them live.

10. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

11. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that AI-generated theme edits will be error-free or produce specific visual results. Always preview changes before publishing.

12. Limitation of Liability

To the maximum extent permitted by law, Rain shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

This includes, without limitation, any damage to your Shopify store or theme resulting from AI-generated code changes. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Rain and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these terms.

14. Governing Law

These Terms shall be governed by the laws of France, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in France.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice on our website at least 30 days before the changes take effect.
